Terms of Use

This English version is provided for information purposes only. This document is governed by and construed in accordance with Turkish law, and the Turkish version is the sole authentic text. In the event of any discrepancy, inconsistency or conflict between the Turkish version and this English version, the Turkish version shall prevail.

These Terms of Use set out the rules for using the Sporara platform. By visiting the platform, becoming a member or making a reservation you accept these terms. If you do not accept them, you should not use the platform.

1. Parties

These terms apply between Sporara Teknoloji Ticaret A.Ş. and Esteprime Özel Sağlık Turizm ve Danışmanlık A.Ş., which operate the platform jointly (together referred to as “Sporara”), and the natural or legal person using the platform (the “User”). The corporate details of the companies are set out below:

Division of services: camp and tour products are sold by Esteprime Özel Sağlık Turizm ve Danışmanlık A.Ş., while activity, course, tournament, membership, rental and package products, together with membership and account services, are provided by Sporara Teknoloji Ticaret A.Ş. The seller is clearly identified in every purchase, and the applicable distance sales agreement and preliminary information form are presented separately for your approval. 2. Definitions

  • Platform: the Sporara website accessible at https://sporara.com and through mobile interfaces, together with all its sub-services.
  • Listing: an activity, course, tournament, tour, camp, membership, rental or package product listed on the platform.
  • Operator: the sports centre, facility, instructor, club or tour/camp provider that publishes a listing and actually delivers the service.
  • Sporara listings: listings created and sold directly by Sporara.
  • User: a person who visits the platform or becomes a member.

3. Nature of the platform

Sporara acts in two distinct capacities, and the capacity applicable to each listing is shown on the listing page and in the purchase flow:

  1. Our own services: for listings created by Sporara, Sporara is the direct seller. The relevant Sporara company is responsible for delivering the service and for the obligations arising from the distance sales agreement.
  2. Marketplace: for listings belonging to Operators, the sales contract is concluded between the User and the Operator. For those listings Sporara is an intermediary service provider within the meaning of Law No. 6563 on the Regulation of Electronic Commerce (Elektronik Ticaretin Düzenlenmesi Hakkında Kanun) and is not obliged to monitor third-party content or investigate whether it is unlawful. Sporara does, however, assess notices of unlawful content within the procedures and periods required by law and removes content where necessary.

For marketplace listings, responsibility for the quality, content, duration, safety and legal compliance of the service lies with the Operator, as does the obligation to hold the necessary permits, licences, insurance and qualifications. Sporara performs reasonable checks when onboarding Operators; those checks do not mean that every service will be performed properly.

4. Membership and account security

  • You must be at least 18 years old and have legal capacity to become a member. For listings aimed at children, the reservation is made by a parent or legal guardian from their own account.
  • The information you provide on registration must be accurate, current and your own. Accounts opened with false information or someone else’s details may be closed.
  • You are responsible for the security of your account and password. Transactions made through your account are deemed to be yours. You must notify us immediately if you become aware of unauthorised use.
  • As a rule one person may hold one account. Secondary accounts opened to evade sanctions will be closed.
  • You may request closure of your account at any time. Closure does not extinguish obligations arising from incomplete reservations or unpaid amounts, and records that must be kept by law will continue to be retained for their statutory periods.

5. User obligations and prohibited conduct

When using the platform you agree not to:

  • act contrary to applicable law, public order or public morality;
  • use another person’s identity, payment instrument or account without authorisation, or enter false identity or participant information;
  • create fictitious reservations or manipulate the system to abuse coupon, campaign or gift features;
  • scan, penetrate or reverse-engineer the platform to test or circumvent its security, or upload malicious software;
  • collect data systematically using automated tools, bots or scrapers, or copy and republish platform content without permission;
  • use the platform to distribute unsolicited commercial messages or advertising;
  • harass, threaten, insult or make discriminatory remarks against other users, Operators or Sporara staff;
  • share contact details in order to move a reservation off the platform and avoid commission.

You must also comply with the Operator’s safety rules, facility rules and instructor directions during the service, and confirm that your health permits participation. You are responsible for the accuracy of any declaration you make about your health.

6. Content, reviews and moderation

  • You are responsible for the reviews, ratings, photographs and messages you upload, which must not infringe the rights of third parties.
  • Reviews must relate to a service you actually received, be based on genuine experience and be relevant. Insults, defamation, hate speech, advertising, disclosure of personal data or irrelevant content will not be published.
  • Fake positive or negative reviews given in exchange for any benefit are prohibited and will be removed when detected.
  • Sporara reserves the right to remove, withhold or block access to content contrary to these rules without prior notice. You will be informed of the reason and may object.
  • By uploading content you grant Sporara a free, worldwide and transferable licence to publish it on the platform and in Sporara’s promotional channels. This licence ends when you delete your content, except for records that must be retained by law.

7. Intellectual property

All intellectual and industrial property rights in the platform, including its design, software, database structure, interfaces, texts, images and the “Sporara” name and logo, belong to Sporara or its licensors. Copying, reproducing, adapting, distributing or commercially exploiting these elements without permission is prohibited. Trade marks and images appearing in Operators’ listings belong to the relevant Operator and are used for the purpose of the listing.

8. Reservations, payment and cancellation

When you purchase a listing, the price, scope and cancellation and refund conditions applicable to that transaction are shown on the listing page and during checkout; the legal framework of the transaction is set by the distance sales agreement and preliminary information form presented separately. In the event of a conflict between these Terms of Use and the distance sales agreement, the distance sales agreement prevails for that sale. See https://sporara.com/mesafeli-satis.

Please note that for leisure services to be provided on a specific date or time, the right of withdrawal may be excepted under Law No. 6502 on Consumer Protection (Tüketicinin Korunması Hakkında Kanun) and the Distance Contracts Regulation; the cancellation and change conditions stated in the listing apply instead.

9. Continuity of service and changes

Sporara may temporarily suspend the platform for maintenance, updates, security or technical reasons and may change the scope, features or listings offered. Planned interruptions are announced in advance where possible. Sporara is not liable for interruptions arising from internet infrastructure, power failures, cyber attacks, force majeure or third-party service providers.

10. Limitation of liability

  • For marketplace listings, liability for performance of the service rests with the Operator. As an intermediary service provider, Sporara does not guarantee the Operator’s performance.
  • For Sporara’s own listings, liability is determined by the applicable distance sales agreement and consumer legislation.
  • Sporara is not responsible for the accuracy of user-uploaded content, for damage users cause one another or for relationships formed outside the platform.
  • Sporara is not responsible for the content or privacy practices of third-party sites reached through links on the platform.
  • The limitations in this article do not apply to Sporara’s intent or gross negligence, or to liability arising from mandatory provisions of consumer legislation.

11. Suspension and closure of accounts

Sporara may temporarily suspend or permanently close your account in the event of breach of these terms, unlawful use, failure to meet payment obligations, suspected fraud or risk to the safety of other users. You will be informed of the reason and may object. Except where urgent safety requirements apply, measures are proportionate to the seriousness of the breach. Closure does not extinguish your rights in respect of completed reservations.

12. Protection of personal data

Detailed information about the processing of your personal data is set out in the Personal Data Protection Notice, the Privacy Policy and the Cookie Policy, which form an integral part of these Terms of Use.

13. Changes to these terms

Sporara may update these Terms of Use. Material changes are announced on the platform and notified to your registered e-mail address before they take effect. Continuing to use the platform after a change takes effect means you accept the updated terms. If you do not accept them, you may close your account.

14. Governing law and dispute resolution

These terms and the use of the platform are governed by Turkish law. In the event of a dispute we encourage you first to seek a resolution through our customer support channels.

Users who qualify as consumers may, under Law No. 6502 on Consumer Protection (Tüketicinin Korunması Hakkında Kanun) and within the monetary thresholds set annually by the Ministry of Trade, apply to the consumer arbitration committee or consumer court at their own place of residence or at the place where the transaction was made. This right is reserved, and nothing in this document may be interpreted so as to restrict it.

For Users who do not qualify as consumers, the courts and enforcement offices of Istanbul (Çağlayan) shall have jurisdiction.

15. Entry into force

These Terms of Use take effect on the date they are published on the platform and remain in force for as long as your membership continues. If any provision is held invalid, the remaining provisions continue in effect.
